Terms of Service

These Terms of Service ("Terms") govern your use of Wummble's website design, hosting, and related services ("Services"). By signing up or making a payment, you agree to these Terms.

1. Services

Wummble provides website design, hosting, local SEO setup, Google Business Profile assistance, and optional AI-powered content editing tools for local businesses. The specific services included in your plan are described on our pricing page at wummble.com.

We reserve the right to update or modify the Services at any time. We will notify you of material changes that affect your plan.

2. Payments & Billing

• Services are billed monthly in advance. Your first payment is due at signup.
• There is no setup fee. You are charged only your monthly plan rate.
• Payments are processed via Stripe. By providing payment information, you authorize recurring monthly charges.
• If payment fails, we will attempt to collect for 7 days before suspending your site.
• All prices are in USD.

3. Cancellation

• You may cancel at any time by emailing hello@wummble.com.
• Cancellations take effect at the end of your current billing period. No partial refunds are issued.
• Upon cancellation, your website will be taken offline at the end of the billing period. We will provide your site files upon request within 30 days of cancellation.

4. Refund Policy

Given the nature of our Services (immediate site build and deployment), we do not offer refunds once a site has been built and delivered. If you have not yet approved or received a site, contact us within 7 days of signup for a full refund.

5. Your Content & Ownership

• You retain ownership of all content you provide (business name, photos, descriptions, logos).
• You grant Wummble a license to use your content solely to provide the Services.
• You represent that you have the rights to all content you provide and that it does not violate any third-party rights.
• Wummble retains ownership of the website design templates and platform technology. Upon cancellation, you receive the content and structure of your site in standard HTML/CSS format.

6. Acceptable Use

You agree not to use Wummble's Services to:

• Host illegal content or promote illegal activities
• Impersonate another business or person
• Send spam or engage in deceptive marketing
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate your account if you violate these terms.

7. Domain Names

• If Wummble registers a domain on your behalf, that domain belongs to you. We will transfer it to your registrar account upon request or cancellation.
• If you provide your own domain, you remain the registrant and are responsible for maintaining your registration.
• Domain registration fees are separate from monthly plan fees and are billed annually.

8. Uptime & Service Availability

We aim for 99.9% uptime for hosted websites. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party infrastructure (Cloudflare, DNS providers, etc.).

9. Limitation of Liability

To the maximum extent permitted by law, Wummble's total liability for any claim arising from the Services is limited to the amount you paid in the 30 days preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost revenue or lost customers.

10. Disclaimer of Warranties

The Services are provided "as is." Wummble does not guarantee specific search rankings, lead volume, or business outcomes. Results vary based on factors outside our control (competition, market conditions, Google algorithm changes, etc.).

11. Changes to Terms

We may update these Terms from time to time. We'll notify you by email at least 14 days before material changes take effect. Continued use of the Services after that date constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of California. Disputes will be resolved through binding arbitration under JAMS rules, except for injunctive relief which may be sought in any court of competent jurisdiction.
